Class Action Lawsuit for GE or Hotpoint Brand Refrigerator

Pending in the U.S. District Court for the Middle District of Florida, Ft. Myers Division, is a class action lawsuit concerning performance issues on the GE and Hotpoint side-by-side refrigerators in sizes 20, 22 and 25 cubic feet. The refrigerators were manufactured by General Electric Company between January1, 2001 and December 31, 2002.

The lawsuit suggests that these models of refrigerators may not perform as well as should be expected because of moisture-related problems. These problems include formation of excessive moisture, wavering temperature controls, excessive frost, and similar issues. If you own one of these refrigerators you can receive a complete list of the determined problems.

For the Settlement Class Members you could receive an additional year of warranty protection through January 12, 2007 or a year past the expiration of any existing service contract. You may also receive a replacement refrigerator if you’ve had to have your current refrigerator serviced, for moisture-related issues, yet continues to have these same issues. And, you can be reimbursed for moisture-related service calls – including parts and labor – incurred between the purchase date of the fridge and January 13, 2006. If you had the refrigerator serviced three times for moisture-related problems, then gave up and bought a new fridge, you can qualify to receive a reimbursement for the cost of the new fridge.

To file a claim each class member must submit a completed claim form, by mail, to: GE Moisture Class Settlement, 2670 Executive Drive Suite A, Indianapolis, IN, 46420. At this address you can get a copy of the notice, claim form, or settlement agreement. You can also call 1-866-839-4463. Your claim form must be postmarked no later than midnight on April 13, 2006. For moisture-related service call claims dial: 1-866-839-4463. The claim form for refrigerator exchange must be postmarked by midnight on January 12, 2007 unless you currently have a service contract and then it must be filed within a year of the ending of the contract. Failure to file by these dates dismisses you from the class action suit.

To be excluded from the settlement class you can send a request to be so excluded by writing to the above address or calling the above phone number. The settlement is scheduled to be heard in the U.S. District Court on April 27, 2006.
